1) NO handguns.  Handgun Control Inc., became the Brady Campaign.

2) NO rifles, and no hunting, as that’s the well-worn excuse for having the damned things.
People get their food from the grocery store, not the open range.  The danger of these guns, which can all be traced to some current or long-ago military arm, is too great.  Become a vegan, all animal-sourced foods are cruel.

3) NO shotguns. 
The FBI crime lab can’t do a “ballistic fingerprint” of a shotgun.  They’re outlawed by the Geneva Convention for use in war.  They contribute lead contamination and undermine threatened and endangered species preservation efforts.

Don’t sort the population into those who might do something evil or foolish or self-destructive with a gun and those who surely will not. As if this could be known—as if it could be assessed without massively violating civil liberties and stigmatizing the mentally ill. Ban guns! Not just gun violence. Not just certain guns. Not just already-technically-illegal guns. All of them.

If anyone ever tells you “no one wants to take your guns” you can just point them at the NYT or any number of other people that have some vague thought of “ban guns” without any thought given to how that might actually be carried out. And we, rightly so, claim they don’t understand what would be involved in such an effort.

Here is someone who as thought it through a bit more. And note that they envisioned Act II Step 1 as happening today, December 11, 2015:

What has to go?
All magazine fed, self-loading firearms.
Yes, that means handguns too.
Yes, that includes your 4 shot Remington hunting rifle.

…

Act I Step 1:
The POTUS issues a EO, commanding the BATFE to “audit dealer records” – ie, look for “strawman sales” by reviewing each of the dealers Form 4473 records.
This is actually easier if the dealer has adopted the eForm 4473

For handwritten forms, an OCR scanner would be carried, the form scanned, and information corrected on a laptop prior to the next scan.

What can’t be done? Is hold a news conference.
It can’t be done by BATFE Agents alone, as this demands too many bodies in too many locations, at the very same time.

We as a nation, will have to let a few things slide, while various agencies supply personnel to work with BATFE Agents.
Yes, a same day, nationwide “I’m here to review your records”.  Close every single gun seller that day, days, or week(s) until the audit is complete.  Sold a hundred guns in your entire existence? We’ll be gone by 4pm today.  Sell a hundred per day?  You can re-open after the end of the year.
It’ll put you out of business?  Impact hunting season and holiday sales? (Which next to DiFi’s failed AWB II is the most money you make in a year?)  That’s sad.
CLOSED… can read GONE OUT OF BUSINESS.
We score that as a win… you and your fellow death merchants can retrain as Baristas.

So, now we have ALL the records scanned… and a comprehensive list of who purchased what gun where.  Those are sorted for make and model.

Shotguns.
Semi-auto shotguns.

Rifles.
Semi-auto rifles.

Rimfire rifles.
Semi-auto rimfire rifles.

Handguns.
Semi-auto handguns.

(save ALL of this data for later)

Step 2: permit the dealers to reopen – however, now the eForm 4473 is 100% required,
and in a slight tweak, batch processing is done once a week, where the forms are uploaded “to the cloud”.
(as-if ‘the cloud’ isn’t on those servers already)

Step 3: Prioritize you list.

Act II Step 1:

Strike a deal with the Republicans.  For public consumption, word it as ambiguously as possible… as was the ACA (just pass it and we’ll find out what’s in it) and stuff it into the next Continuing Resolution.

On this 11th day of December, 2015 this 114th Congress does hereby resolve to instruct the Department of Justice to audit all Federally Licensed Firearm retailers for compliance with 18 USC as condition of their license, and direct all necessary resources to do same.  The Director of the BATFE, the Attorney General of the United States, and the Director of Homeland Security may adopt policies and procedures necessary to effect this Congressional mandate.

About those Republicans:
First, they’re really not that happy with massive civilian gun ownership, they just like the cash from the pro-gun crowd.
BREAKING NEWS!!
They like the cash from Wall Street, and Corporate America better.

Give Congress the choice between:
a) massive controls on financial transactions, killing their benefactor’s proven-risk derivative market
– or –
b) massive (armed) civil unrest when we pull a Greece and shove a total economic collapse onto the American taxpayer?
Rationed water, electric, heat, food and fuel and a 65% tax on your income.

Everyone other than a Tea Party Republican will choose to eliminate the risk of option b.
The motion will pass.

There’s going to be a political quid pro quo. I’d hang my hat on “illegal immigrants” taking it in the neck. How and why, is below.

Step 2:
Federalize (“second”) the National Guard of the respective states.  Just as we could send them to war in Iraq, we can deploy them as deputized federal agents. One BATFE agent to 3 or 4 guardsmen.

Step 3:
Go door-to-door with your list of gun purchasers, and get access to the guns.  A massive VIPR-like sweep.
No gun? Where is it?
Who has it? Where’s the paperwork?  No gun, no paperwork?

Sadly, it appears the nationwide cell phone network is down, unless you’re using a government contract cell phone.

Step 4:
Anticipate the Federal Court Injunctions.
Injunctions which are enforced by… the DOJ and US Marshals.
Who are preoccupied in carrying out the mandate of Congress.
You’ve reached the DOJ, leave a message at the beep.

Step 5:
Mistakes happen.
Somewhere in the process, an “honest mistake” happened.

Knock, view, verify and record the presence of the named firearm in the possession of the named owner – or find out who has that firearm – was misinterpreted.

Knock, bash-in the door, verify the presence of, and confiscate the named firearm – became the process.

Rules of Engagement were defined as: “take no incoming fire – lethal means authorized”.
A few “rogue operators” decided that if it looked sketchy, breach the door after the flash-bang grenades, and engage anyone seen with a firearm in proximity using lethal force.

Step 6:
The number of confiscated firearms becomes a problem.  National Guard units are directed to turn the contraband over to Active Duty Military Police.  Certain weapons may be re-purposed by the government, exported to allies, used by agencies, or stripped for parts.

Light alloys are put into a grinder, steel and stainless steel are cut with a plasma torch to render  non-salvageable (prevents theft in transit), then taken to a smelter to be melted down.

Step 7:
The higher Federal Courts, and perhaps the SCOTUS weigh in.

Answer A: “It’s gotten out of hand, and we can’t reach all of the field units… your order to cease is understood and complied with at the Executive Level.  The logistical issues however, preclude prompt compliance in the field. The majority of units are out of contact, operating independently beyond range of communications.”

Answer B:
Arrest those Judges.  What part of Congressional Mandate didn’t you understand?

There’s going to be some issue, with a few mouthy Governors complaining about “…patent misuse of the Guard, violation of the Constit…” Yep.

But the bottom line is this is not someone who has some vague vision of rainbow farting unicorns carrying away all the guns being turned in for destruction and everyone living happily ever after.This is someone envisioning bypassing legal restraints, separation of powers, and with the complete disregard for the Bill of Rights imprisons or murders whoever stands in their way.

Given that even micro gun control measures will be effectively blocked by the NRA and its allies, and that promoting mini measures as potentially effective is misleading, progressives may as well go for the big enchilada: Call for domestic disarmament.

One may say that the Supreme Court, after 250 years in which the Second Amendment was read as allowing only a well-regulated militia to have guns, recently reinterpreted it to mean that there is an individualized right to own guns. This suggests that we may have to get to domestic disarmament through the back door.

Make the gun manufacturers liable for harm done with their products. Ban the sale of ammunition. And vote for a president that will add to the Supreme Court those who will read the Second Amendment as written.

Above all, domestic disarmament is a true, compelling vision which cannot be said about the small gun control measures that are currently promoted by some of the most enlightened people among us.

[It’s amusing that someone so ignorant and naïve talks about knowing who is “enlightened”.

All nine SCOTUS justices agreed the 2nd Amendment protects an individual right. He thinks its plausible to replace five or more of them with people that will reverse that and ignore all the evidence going back hundreds of years? And then once you have a court that will allow such laws to stand does he can get the votes in congress?

And does he think making gun manufactures liable is going to pass muster in congress or the courts? We currently have a law specifically protecting them from liability.

And banning the sale of ammunition? That’s not only legally problematic but practically impossible. Recreational drugs are impossible to keep out of the hands of teenagers. Ammunition will be no different.

The most amusing is the part where he says “micro guns control measures will be effectively blocked” so they “may as well go for the big enchilada”? That’s like saying, “We can’t get away with robbing the local mini-mart so we might as well go for Fort Knox.

These people are apparently incapable of rational thought!

The one thing he has right is that he has a “compelling vision”. It’s compelling evidence that he is delusional and well as bordering on criminal behavior.

End the Gun Epidemic in America

The NYT just published a front-page editorial (The first since 1920!) Advocating for the banning and confiscating of firearms.

You might just be able to drop the topic finally. 😉

The topic being “Don’t let anyone tell you they want to take your guns.” But that assumes there are enough people reading the New York Times for the word to get around.

My take on this editorial is this will further reduce their readership. More and more people realize that with the war with our current enemy for people to advocate gun control is an incredibly stupid idea. Even Chris Christie, who governs a state with incredible strict gun laws, called this editorial, “typical liberal claptrap from the New York Times”.

Yesterday Barb and I were at the range with a relatively new shooter and her husband. The check-in counter and gun store was packed with people. I supposedly had the training bay reserved for them but it was packed with a class. The range gave us a smaller bay and we got her shooting much better and far more comfortable with a gun. She is going to get a CPL.

My point is that rational people realize the answer to violent criminals is to respond with immediate protective violence and the best tool for that is a gun. People advocating removing the tools for delivering that immediate protective violence are being ignored and even anti-gun groups and President Obama recognize this:

President Barack Obama made a promise in October to use his bully pulpit to politicize gun control. But he hasn’t followed through — he hasn’t scheduled a single speech on the topic, instead simply reacting to shooting after mass shooting. And he’s stopped pushing for any real legislation with members of Congress.

Obama frequently repeats his promise to do something. But aides say he’s essentially given up on any significant gun control passing during his presidency.

…leaders of the groups grumble. They still get invited to intermittent brainstorming sessions at the White House where they hear talk about securing a legacy with some more moves, and then they wait as nothing real happens.

We have seen over this past week how quickly an important social conversation can really change how we look at an issue.

The conversations I had at work, with friends wanting guns and training, and the packed gun ranges and stores over this past week we do see that, speaking literally, Gross is right. I can think of many reasons why citizens should own and use the type of firearms she wishes to ban. And like a fish who doesn’t know what water is Ms. Subeck doesn’t have the imagination to recognized the most obvious reason. That is, the number one reason for owning and becoming skilled in the use of these type of firearms is to defend ourselves against people like her who are contemptuous of basic human rights.

In addition to the general stupidity of her media release her bill demonstrates she is clueless in many dimensions. Here, for example, is her description of the pistols to be banned from the proposed bill:

3.  A semiautomatic pistol that has the capacity to accept a detachable magazine and that has any of the following:
a.  A folding, telescoping, or thumbhole stock.
b.  A 2nd handgrip or protruding grip that can be held by the nontrigger hand.
c.  The capacity to accept an ammunition magazine that attaches to the pistol outside of the pistol grip.
d.  A threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer.
e.  A shroud that is attached to, or partially or completely encircles, the barrel, and that permits the user to hold the firearm with the nontrigger hand without being
burned.
f.  A manufactured weight of at least 50 ounces when the pistol is unloaded.

She has crap for brains and should be treated as such.

But the real lesson to remember from this is:

Under the bill, whoever transports, purchases, possesses, or transfers a semiautomatic assault weapon is guilty of a felony and may be fined up to $10,000, sentenced to a term of imprisonment of up to six years, or both.

SAFE act

The 2nd Circuit Court upheld the NY “SAFE Act 2013” last week. Bummer. They said that NY could ban certain arms, prohibit private transfers, etc. On the one hand, that really sucks for the people of NY, another in a long line of suckage. Oh, well, I don’t live there, and I’m never planning too. And it sets a circuit court precedent that specific guns can be banned. On the other hand, it was passed so fast, and is so broad, it’s likely to get appealed to the Supreme Court, and it’s also likely to get taken up.

High risk appeal. If we win, it’s big. If we lose, it’s HUGE.

Interesting times.

We’re now actively debating things that no civilized country has ever even contemplated – the right to take a semi-automatic weapon into a family restaurant or shopping mall.

Nope. That debate was over years ago. We have concealed carry (theoretically, even if it is impractical in some cities or states) in the entire country. Since this guy clearly doesn’t know or care to know what he is talking about you can safely dismiss everything else he has to say except this:

yes, we really do want to take your guns. Maybe not all of them. But a lot of them.
