Throughout history, many theories have been propounded as to the black robes worn by judges. Some say they provide a symbol of the authority and power conferred by the state, while others suggest they foster uniformity and promote the concept that justice remains blind. Judges like Katzmann and his First Circuit cohorts, however, bring modern clarity to the garb, as it seems the real symbolism behind the black robe is the death and mourning of our Constitution.

While he has a point, this is not true of all the judges. I could agree even if he said most judges. But not all.

  1. Take the robes away. Make them wear suits or perhaps clown garb. Take the benches away. Abolish the saying of “your honor”. Stop the practice of having everyone stand. All these are trappings of royalty which have no place in a republic.

    • If you ask WordPress, it says 143 for this post. But every single comment is spam. This was back in the day when I was using different blogging software, and it did not have a spam filter available for it.

  3. No particular reason, a couple of threads I’ve followed seem to have gotten a lot of back and forth discussion and wondered how long these might have gone on.

    There’s a fundamental problem with this hypothesis: The bad judges who desire the death of the Constitution would not mourn its passing.

    And we should never consider planned maliciousness as stupidity.
    It’s just made to look like illiterate, corrupt, stupidity. That way you diminish them in your mind at the same time you feel powerless against it.
    And you mentally move on too,,,,,,you know- you know- the thing.
    Only one way communists lose power? When it’s taken from them.

  6. I understand the symbolism is for other-worldly authority in the minds of those viewing them. A symbol for fear and respect.
    I’m pretty sure today it’s more for covering up masturbation.

  7. It may not be true of ALL judges but the number for which it is not will be vanishingly small…
