He is not wrong. It seems to me they need to rachet them both down essentially simultaneously. They protect each other.

  2. SF writer L. Neil Smith argued that the entire Bill of Rights should be considered indivisible, since after all it was the condition demanded by the states for ratifying the Constitution in the first place.
    It’s curious that Madison claimed it is redundant, because nothing in the original Constitution allows any of the things that the Bill of Rights then explicitly prohibits. He may be right in a way, but history has shown that rights get infringed even when explicitly protected. The push to do away with the 2nd Amendment makes that very clear: if it were simply repealed the Federal government still would have no authority under the other articles to limit the ownership of guns, that’s quite clear in the plain English text. But axe grinding politicians have invented such authority out of whole cloth, by schemes like subverting “regulate commerce” to include “ban commerce”.

    My personal “favorite”, at least recently, is Obamacare.

    It’s justified by the interstate commerce clause. By federal law, *there is no interstate commerce in insurance*.

    How can they regulate any further than that? It is, *by law*, entirely intra-state commerce being legislated… using the interstate commerce clause as justification. Complete nonsense.
