When this court exercises “power on behalf of the people and in fulfillment of [our] responsibilities, obligations, and service to the people” we “may contemplate and reside with the life force and give consideration to the ‘Aloha Spirit.’” HRS § 5-7.5(b) (2009).

The spirit of Aloha clashes with a federally-mandated lifestyle that lets citizens walk around with deadly weapons during day-to-day activities.

  1. Holy cow. It seems they are saying that Hawaii is exempt from the Constitution and instead can apply some weird religious cult as a substitute for laws. “Federally mandated lifestyle” is how they describe the plain English mandate of the Constitution?

    It would be interesting for the US House to impeach these “justices”. It’s a bit of a stretch to do so, but I would argue it is covered by Article IV (“guarantee a republican form of government”) and Article VI (requiring oaths to support the Constitution).

    • “Absolute immunity” for States’ Attorneys and judges is also a “federally-mandated lifestyle”.

  2. How does a person support FPC – without generating an avalance of new requests for MOAR money, and from other “conservatives” that want your money? I used to support SAF, but each contribution to them lead to still more SAF requests. Then more requests from related organizations. Same thing from supporting a local conservative in a statewide election. Suddenly “conservatives” from all over the USA were sending requests – I guess their fellow citizens of whatever state/city weren’t impressed enough to fund them.

    Until I see an organization promise to keep my contributions anonymous, and not sell me around the country, NOT ONE MORE PENNY!

    • I donate through my employer (which matches my donations). No spamming emails, no junk mail, and no calls.

      • Seconding Joe. If you want to give FPC money, you have to go to them. They send mail after a donation, once.

But the “Aloha Spirit” did not prohibit or prevent the ferocious battles between the islands that took place before unification under King Kamehameha, If your head is chopped off with a fire-hardened wooden sword you are just as dead as if you were shot. The only difference is that instead of every little lady having a gun to punctuate her “no” with, they are unarmed and must comply with whatever the big Pacific Islander men say they should do (yes, yes, I know, “Teach Men Not to Rape”, but that’s been a law for — what, four thousand years? Until they learn not to, what should women do?).

  5. Seems to me that Statehood brings with it a demand that Territorial laws must be put aside. By becoming a State in the Union, you agree that the Union’s overarching laws have now become yours, and when laws are interpreted through the Union’s Constitution, that interpretation applies to your State just as to any other.

    • Absolutely. Not to mention that “…all executive and judicial Officers, both of the United States and of the several states, shall be bound by Oath or Affirmation, to support this Constitution…” (Constitution, Article VI).

      • I have bad news. All Democrats and most Republicans ignore this and nothing is done.

    • Does that include Texas telling Biden to get bent, they are going to use razor wire anyway? Asking for a friend.

      • Texas has a reasonable argument that protecting their southern border is more in line with Constitutional directives than Biden’s attempt to keep it open.

        Now, if Texas wants to get serious about it, there are unlocked and open gates in “The Wall” less than a half-mile in either direction of Eagle Pass. They could close those up, too. Otherwise, the razor wire and the “State vs. Fed” tiff are glorified publicity stunts.

    And once again. It’s not guns they want to get rid of.
    It’s YOUR guns they want restricted.
    It’s aloha my ass if you do something the court/government don’t like.
    Then it goes all spirit of SWAT.
    Like Vox Day says; “You can’t fix zombie”. Well, actually, you can. But that’s an option for another day.

  7. The “Aloha Spirit” might inspire Constitutional interpretation, but the interpretation you’re required to listen to is the U.S. Supreme Court’s, and they were very clear, twice. Once in Heller, and reaffirmed in Bruen.

    The First Amendment says Congress shall make no law establishing a state religion, and that mandate is incorporated to all branches of federal, state, and local governments. Ergo, the Hawai’i Supreme Court cannot legitimately cite any “spirit” that supersedes the plain text of the Constitution.

  8. Yet another example of a court deciding that they are going to deny, delay, delay and delay some more and then let the slow appeals process let them have their victory. They are gambling on SCOTUS not accepting an appeal and letting their little tantrum stand.

    And, well, they have a point. What is going to happen to them? Nothing until SCOTUS strikes them down again. Then what will they do? Repeat the process with another bogus line of reasoning. Rinse, later, repeat. They’ll keep doing it until Federal troop march in to take them into custody.

    They are very much living the adage. “They made their ruling. Now let them enforce it.”

    This is how the United States dies, people. Not overt civil war. The death of the rule of law. When the rule of law is utterly ignored in favor of legalizing personal preference without consequence, it will split the country politically and no one will have the bravery to actually do something about it. They’ll just apply preferred laws locally, ignore the rest and challenge those who oppose them to do something about it.

    I’ll wager they’ll still be doing it a decade from now. They have decided that the law will mean what they want to and ignore the rest.

  9. Is it accurate to state that there is NO physical and/or financial means for the Supreme Court to force these scallywags to abide by the rulings?

    So, it comes down to the People dragging them out of their offices and finding a suitable tree or lightpost to affix them to, as there seems to be no intermediate step?

    I wonder if their fellow travelers understand that when that happens, lots of them will be swept up in the festivities to join them? It will be like rolling a small snowball down a steep hillside. It doesn’t stay small, and pretty much sucks up everything in it’s path.

    Do they WANT Larry’s Lightswitch to be flipped? Or, are they of the opinion that it will never happen here? If so, History says they are very much mistaken. “Interesting Times”, indeed.

    • I’m not a lawyer, but I thought the Ferderal courts could hold them in contempt of court and have the Secret Service arrest them.

      Federal prosecutors could almost certainly charge them under 18 USC 242.

      • Could but won’t. Pretty sure it would be the Federal Marshals, not the Secret Service, though should the Supremes ever locate their balls.

        As long as we are fantasizing, how about if the Supremes counter-nullify the Hawaii court. Preemptively, strike down every decision they make on any subject.

  10. Just another instance proving we are no longer a nation of law. The left and their pet black robed pirates KNOW they will face absolutely ZERO consequences for violating laws, Rights, the Constitution, morals, ethics and anything else they can transgress. And as long as that is the reality we live in they will continue to do so. They are LAUGHING at us. Openly and blatantly.

    • And they just lost the narrative that laws matter. And that they have anything to do with justice.
      They just made themselves into crow’s squawking over a corpse.
      Just as Covid destroyed the narrative that doctors are all about your health. And government is all about keeping us save.
      They may be laughing, but the jokes on them as well.
