Seattle City Council mulls law that could result in dismissal of many misdemeanor crimes

The Seattle City Council is considering new legislation that would create a legal loophole that would make substance addiction, mental illness or poverty a valid legal defense for nearly all misdemeanor crimes committed in the city.

The legislation was proposed by Seattle City Councilwoman Lisa Herbold last Wednesday.

The proposal would allow for the dismissal of crimes of poverty and it would do so by revising the definition of duress as a defense against prosecution.

If approved, the ordinance would excuse and dismiss — essentially legalizing — almost all misdemeanor crimes committed in Seattle by offenders who could show either:

  • Symptoms of addiction without being required to provide a medical diagnosis;
  • Symptoms of a mental disorder; or
  • Poverty and the crime was committed to meet an “immediate and basic need.” For example, if a defendant argued they stole merchandise to sell for cash in order to purchase food, clothes or was trying to scrape together enough money for rent. The accused could not be convicted.

It’s like during the Russian revolution. The criminals were considered allies of the revolutionaries because they stole from people with private property.

Who would attempt to have a shop in Seattle with a law like this? Or even have a home in Seattle?

One has to conclude the City Council members who vote for this are deliberately trying to destroy the city and/or are out of touch with reality.

  1. wtf is wrong with people…not sure how they can change the penal code, normally the definitions are done by the state when the law is passed…the city could probably get rid of their own city mandates/ordinances…but then they only hurt themselves even more since businesses are leaving…those fines from city tickets are budgeted money…you are right, it’s like they are trying to destroy the city on purpose…

  2. I wonder if they know anything about what happened to the carpetbaggers and do-gooders after reconstruction ended in the South or the horrors of the Russian revolution.

    • Presumably, only works in Seattle municipal court, but if the SPD disbands by the expedient method of all the cops saying “fuck this noise”, and the King County Sheriff has to take over…

  3. If ever facing a choice in politics, as wither some politician is evil or just mentally imbalanced.
    We should consider them to be evil. And grossly so. As the penalty is the same for you and them. And you will almost always pay that price first.
    The common citizen will always have to pay for government’s……Evil.
    It would appear the people of Seattle have some hard choices to make.
    Unfortunate that.

  5. A city ordnance does NOT take precedence over the states penal code. MOST such crimes are crimes under a states penal code. The city of Seattle CANNOT legally circumvent those codes.

    • If you read the quoted stuff carefully you will realize they are being rather clever. They are “revising the definition of duress as a defense against prosecution”.

      • True, but is that any different? That’s also a legal technical term defined by state law, over which the town has no authority.

        • Aren’t these the same people that declared themselves above the federal aiding and abetting illegal alien laws?
          Stood by as their city was being burned and looted?
          Something tells me their not to worried about thing legal. Just saying.

  6. I’m thinking the same. It’s time to leave the so-called liberal areas of the country before you find yourself in a forced migration or worse. Personally, we’re not in Seattle or King County, but we are way too close for comfort.

    However, be forewarned, this scourge will find you, but at least if you are with like-minded folks you’ll be in a better defensive position. From history we know that scourges like this have reached every nook and cranny across borders, mountains, and seas. And this one has the potential to be global including your like-minded folks.

    Think the residents will gather a necktie party early enough to save the place? Or, is that an unreasonable expectation?

    • I think the residents who are aware enough to see the writing on the wall are in the of process moving, or already have moved, out. Daughter Jaime, in nearby Bellevue, moved 40 minutes further out last month. I’m not sure who she sold her Bellevue condo to but the market was hot in part because of all the people wanting to leave Seattle. Fast Internet means many people with office jobs can work from anywhere they have a good connection. That is a lot of the high paying jobs in the Seattle area. That means construction and a lot of the low paying jobs in things like food service and retail will be hard hit. And a lot of those people will go looking for jobs outside the city when unemployment, stimulus, and other “safety net” stuff runs out.

      The only people moving into Seattle will be those who want to take advantage of the “Free stuff!” situation. The exit of money and entrance of criminals will result is “interesting” times.

      So, I don’t think it will be saved. It will become a “socialist utopia”.

      • So what happens to the suburbs and exurbs as the city core becomes a ‘socialist utopia’? Is there a way to contain this process without establishing armed borders with limited interaction?

        I would expect that there would be continual pressure – including force – on the suburbs and exurbs. And that this would be even more true when mass hysteria is involved.

        For containment it would take people with strong sense of right and wrong with lines that cannot be crossed both literally and figuratively. It’s not obvious that condition exist at least where I live.

  8. The real problem is in perception. There is absolutely no reason for millions of people to dislocate themselves over a handful of communist!
    What are we, France?
    Easy for me to say? As I live in a rural town. (trust me, I paid the price to do that.) But it wouldn’t matter. We KNOW right from WRONG. And better to die fighting for right. On your own ground. Than to starve to death trying to hide from wrong.
    For all we know this is a deal between Soro and Trump to buy up and rebuild Seattle cheap?
    Shoot back. Vote, do jury duty. And remember, This is mine, I ain’t running! Why, BFYTW! Americans don’t run!

  9. The proposal to allow poverty and addiction and mental distress as defenses against misdemeanors is only the first part of the creation of the gulags. Next comes the mandatory incarceration of select groups of those using this defense, for their retraining, or re-education, or substance abuse treatment, or psychological counseling, until you are a productive member of the state. And if you happen to die in the labor camp being re-educated, or spend the next few decades drugged in a psych ward, well, that is for the greater good of the state, and you should appreciate that.
