I wouldn’t be so hard on Congress if they would just stay within the bounds of the U.S. Constitution. That they don’t means they are criminals and should be treated as such.

I view the failure to not have consequences for politicians overstepping their authority the single greatest fault of our constitution. I would like to see something like every time one of the laws they voted for was declared unconstitutional meant another five years was added to their prison sentence and a $1000/day fine for every day the law was in effect. It wouldn’t be a perfect solution but it would be better than what we fail to have now.—Joe]

  1. Well, if it takes you 11 years to get around to doing something, Maybe our forefathers weren’t to keen on congress either?
    We just forgot that our forefathers had no problem with deposing of tyrants using manly force if necessary.

  2. Both some Greeks and the Romans had the concept of private prosecution of public figures. There were some obvious abuses to be sure but on the other hand public figures didn’t have the immunity that they seem to have in this soon to be banana republic.

    Perhaps a compromise would be automatic standing for anyone alleging a violation of an enumerated (no penumbras or emanations) right. Wouldn’t mean they would always win but they would always get a hearing. This could be done by statute, I think. Of course, you would still need to worry about Roberts decreeing that the statute was unconstitutional. Constitution says the Congress has control over jurisdiction but Roberts has gotten away with making stuff up before.

  3. This is also a really good reason to support term limits for Congress. Of course, legislators will say “Well, we can always get voted out”, but when incumbents win well over 90% of the time, how real is that statement?

    The more they (legislators) say term limits are NOT needed, the more you know that we DO need them.

  4. We need a new Amendment. Every Fourth of July at noon, we must hang one congresscritter on the Mall. Pour encourager les autres.
