There will be lots and lots of grounds for overturning this. Congress can, of course. The courts can for lots of reasons. Violation of the Administrative Procedures Act is certainly a slam dunk.
A really good argument that unfortunately is unlikely to be tried is that the FCC isn’t authorized to do this because the FCC isn’t allowed to exist at all, under the Constitution. (No “independent agency” is Constitutional. It’s really that simple.)
I am getting really REALLY fed up with reading posts from people basically saying that they are the only ones active about this and where the Hell am I?

The problem is that they blithely ignore me and pass this stupid crap anyways. Come election time, it seems I am the only person interested in primarying the turncoat bastards or putting a different party in the seat. I am the lone crank who bothers to find out where the party HQ’s low-rent location is this cycle and go and complain.

They are. Don’t think of the “Left” and “Right” as two opposing parties engaged in an ideological tug-of-war over the direction of the country. Instead, think of them as the left and right feet of a great monstrous Leviathan, alternately and steadily plodding toward the edge of an endless chasm. If one foot should fail to move forward, the whole beast could stumble and fall.
Sometimes I wonder if tripping up the Leviathan would be such a bad thing.
Archer; For years I’ve referred to the two parties as the “good cop and the bad cop”. They’re working together to take you to the same place, but depending on your outlook, one of them will appear to be your friend, saving you from the “bad” cop, but your model works too.
I don’t think any of us really has any idea just how thoroughly corrupt they are, and what that total corruption makes them capable of doing, or not doing, if they believe they have a chance of getting away with it.

The independent agency thing keeps biting people again and again. FCC, EPA, OSHA. Every time I turn around there is some other byzantine maze I have to navigate to figure out what I can and can’t do.

Are you kidding? This is allover the…um…Internet. Whenever people like you or I bring this up, the Left eagerly smashes back with name calling and non sequiturs. They are well aware of how much rational people are against it.
People like this need to be prosecuted under 18 US Code § 242, and the conspiracy to do the same, and maybe a few others, as well. Sting them up by the lamp post.
This sort of power grab has been done in this country now for 100 years. If the prosecution you speak of is ever to happen, it will require a major sea change.
I wonder how many of us in the pro freedom blogosphere really understand the depth and scope of the corruption, outright criminality and depravity we face in the highest levels of government, and the degree to which it’s metastasized throughout all levels.
The main benefit of the Obama administration (following in the footsteps of the Clinton 1 administration) is that it has made a lot of that corruption, criminality, and depravity a lot more visible than it has been before.
