I have just finished re-reading “A Piece of History” and I would like to know if you think the state legislatures of Montana, Tennessee and now Ohio may have hurt the case for incorporation by passing the laws supporting states rights.
No. I don’t think it will.
Both are saying the same thing–the government doesn’t have authority to restrict firearms in the respective contexts.
The states are saying the Feds have not been given the power to restrict firearms within the boundaries of the state because it doesn’t affect interstate commerce. The McDonald v. Chicago case says the states do not have the authority to make these sort of restrictions on firearms because it is a violation of a specific enumerated right.
In both cases it’s about pushing back on government that has overreached the power given to it.
